Contract Terms and legal Agreement for all Assignments

All Clients hereby read, understand, and accept the below-mentioned Contract Term for any photography or video service covered under Magic Dust Productions LLC / Magic Dust Photography / Magic Dust Studios brand.

At the time of the booking  the client shall pay a non-refundable amount of $100 for studio and mini session, $100 for newborn and event photography assignments, 50% of contract cost for wedding, . The deposit amount will be applied towards the session fee for photography/video/DJ services. 

All deposit fee is non-refundable. A notice of 30 days must be given for the cancellation of this contract by the client. MDP shall credit the deposit against any photography assignment within 3 months. This credit is non-transferable and will hold with the said client only. Any cancellation made with less than 30 days will have no refund and no credits will be eligible for a future photography assignment for the said client. If the cancellation is initiated by the photographer due to unfortunate and unavoidable circumstances, the session fee will be refunded 100%. We extend 100% refund within 10 days in case of any medical emergencies or incremental weather conditions.

The client agrees to pay upon the date of the session the final amount due. In return, Photographer agrees to provide the agreed number of images within 3 weeks [or the agreed timeframe depending upon the nature and complexity of the deliverables]. The session fee will add 10% [service charges and tax with invoice] for all payments through credit card/ check/ bank transfer. For the outdoor sessions, the parking fee, parking, and any associated fee will be paid by the client unless specified in the package.

TRAVEL FEE: 

Distance from MDP studio to 5 miles (Free), 

5-10 miles (add $50 to the package cost) 

10-20miles (add $100 to the package cost)

All deliveries of the pictures are final and will not have any revisions.  Any video that needs the addition or deletion of content will be a paid assignment. You will find a small logo of our company at the bottom right corner of all the pictures and videos that we deliver and that is the way we deliver all our discounted/ negotiated services. No Logo pictures are deliverd only for actual package cost along with $7.75 tax paid when you sign the copyright contract and model release document (not applicable to discouted package).

PLEASE NOTE: 

1. We do not deliver RAW files

2. The number of pictures deliverd for a typical event photography is upto 50 digital images/hr of booking, for Portrait sessions 10 images/hr, we however aspire to deliver more every time.

3. The quality of all images we deliver are in line with the type of photographs for a particular session as you see in our website and Facebook posts.

Any pictures that need a re-touchup or artistic editing will a separate paid assignment starting $25 per image. Re-touchup jobs involve  Removal of facial shine, stray hairs,  whitening of teeth and eyes,  braces removal, skin blemishes,  head swap, hair color change, open/close eyes,  background replacement, posture & face slimming, and any alteration to the original image not in the scope of editing.

All images will be available for download for 8 weeks following the session date. The photographer is not responsible for storing images/video files beyond the 8-week period. Online Gallery if specified will be deleted after 8 weeks. 

The copyright of photographs remains with the Photographer. The Photographer grants the Client permission to make copies of the images under the following conditions: The images taken by the Photographer are only for personal use by the Clients. Sale, publication, or any Commercial use (including use of the pictures for competition and product branding) of the photographs is not allowed without prior written permission from the Photographer under contract. 

The Clients grant the Photographer and its legal representatives, heirs, and assigns the irrevocable and unlimited consent to use the photographs for editorial, competition, advertising, promotion without restrictions; and to copyright the images. The Clients hereby release the Photographer and its legal representatives, heirs, and assigns from all labiality and claims in connection with the images. 

The photographer is not responsible for any damage to person(s) or property during the photo sessions. The client is responsible for their own belongings, children, and their safety. The client releases Photographer for any and all liability. 

The client agrees to indemnify and hold harmless the Photographer from any claims, losses, fees, attorney fees, costs, and judgments against the Photographer that result from acts or omission of the client, client’s family members, or any acting agent of the client.

 This contract shall be governed by the law of Georgia state.
